Article 1 – Application and modification of the terms and conditions

The current terms and conditions apply to all orders made on the internet site www.colombianoz.com .

Colombianoz reserves the right to amend or modify the current terms and conditions and any future terms and conditions.Where an amendment has been made such amendment will apply along with the unamended general terms and conditions that are in force on the day of the order.

It is possible to contact Colombianoz by email, telephone or by post. For each correspondence please note your full name, email address and the reference number of the order.

The goods available and the prices of the goods are valid as long as they are viewable on the internet site and are subject to the availability. If the goods are temporarily unavailable after the order has been placed, we will inform you by email or telephone as soon as possible and you will have the option of either changing or cancelling your order.

The price for the goods is quoted either in euros, pounds or us dollars. The price quoted excludes the cost of packaging and transport unless indicated otherwise. Unless indicated otherwise the value added tax in force in France at the moment of the order is included within the price.

We reserve the right to change the price at any and all times. We shall apply the prices that are in force at the date and time of your order (subject to availability), and we will apply the prices that were in force at the date of your order if the stock is temporarily unavailable.

The date the order will be confirmed will be either :

•  the date of the order where payment is made by credit card
•  the date of receipt of the cheque where payment is made by cheque

In both these circumstances all orders are subject to these terms and conditions.

Payment can be made:

The payment is made by the secure banking server of our partner bank Crédit Agricole. This means that no banking information of yours is transmitted by the site www.colombianoz.com . The payment by credit card is therefore secure; your order is recorded and confirmed on the acceptance of the payment by the bank.

The details of your credit card are encrypted according to the SSL protocols and are never transmitted unencrypted on the network. The payment is effected directly by the bank. Colombianoz does not have access or hold any of this information.

Cheques are to be made out in euros and addressed to “Colombianoz”

From the date of placing order, the order and goods will be reserved for a period of 5 days to allow receipt of the cheque. If we have not received your cheque during this period then the order will be cancelled.

Article 7- Terms of delivery and delays in delivery

The goods are sent in France by post and are packaged appropriately and in accordance the requirements of the postal service.

We are able to post goods to all countries.

The goods are delivered to the delivery address that has been provided by you during the course of placing the order.

The costs of postage and packaging are calculated in accordance with the weight of the goods ordered and the charges imposed by La Poste, the French postal service.

The total costs of delivery are clearly indicated during the process of placing the order and deemed to have been agreed during the course of placing the order.

Delays in delivery

The time taken to deliver the order within France is 3 working days (Monday to Friday) and 7 to 12 days outside of France. However, these delivery times are indicative only and beyond our control and therefore we are not responsible for any delays from postal delays.

In case of non-delivery of an order or part of an order, you have up to 3 months (commencing from the date of the dispatching the order by us) to notify us. Any notification received after this period will not be accepted and we are under no further obligation to resend the order.

In accordance with Article L.121-20 of the consumer code, the consumer has 7 seven days to exercise their right to revoke without grounds or payment of any penalty, save the costs of postage and packaging which remain payable. The time period of 7 days starts the day the order is placed.

The goods must be returned in the original state and in their original packaging. Any returned goods that are incomplete, damaged, marked or dirty will not be accepted or exchanged.

You have a period of 7 days from the date of placement of your order to notify us of your wish to return the goods by email info@colombianoz.com or by letter to the address indicated above.

From the date of your request to return the goods, you have 15 days to return to us the goods in their original state and in their original packaging. The costs of postage for returning the goods are to be borne by you.

This article does not apply in the case where the goods are returned on the grounds of damage or they do not comply with the order.

After receipt and acceptance of your package, within 30 days, we shall refund the price of the goods without the original costs of transport and packaging relating to your order.

Article 10 – Guarantees and After-Sales Service

We will refund or exchange any goods that do not correspond with your order (either defective or do not comply with the order placed). In this situation you must inform us by email at info@colombianoz.com or telephone (33 (0)2 56 29 04 31) within two days from the date of receipt of the goods. For all requests in these circumstances the client must indicate their address, the order number, a description of the goods, and the reason for the refund or exchange. Any requests received outside of the two days will not be accepted.

In the case of defective goods or where they do not correspond to the order then the costs of shipping, delivery and return, will also be refunded.

Article 11 – Statement of the Law – “Information and Freedom”

At all times you have the right of access, of modification and deletion of information that you have given and which is in relation to you (article 34 of the law “Information and Freedom” of 6 January 1978).

When an order is placed you agree to allow us to send you information regarding goods and activities of Colombianoz by a monthly newsletter. If you do not wish to receive this monthly newsletter then please send an email to info@colombianoz.com.

Article 12 – Force Majeure

The society COLOMBIANOZ is not considered to be in breach of their obligations pursuant to any specific order in circumstances as set out in this article or such similar circumstances that are beyond their control or are deemed to be equivalent to a force majeure. The following circumstances will be considered force majeure events and this is not exhaustive: natural disaster, fire, earthquake, storm, flooding, government or legislative decisions, fault of the electric network, strikes of public transport and supply of public communications, loss of connection to the internet due to the public or private operators on which COLOMBIAWOZ depend.

In the case of a force majeure event or an event similar to a force majeure event the society COLOMBIANOZ will notify the client as soon as possible.

Article 13 – Jurisdiction

The interpretation, the execution, the validity and/or the breaches of the present contract and terms and conditions will submit to the tribunals of France and judged in accordance with the law of France.
